These Terms of Use (the “Terms”) govern access to and use of Tiko, a Discord bot and its related features (collectively, the “Service”). In these Terms, “Tiko,” “we,” “us,” and “our” refer to the operator of the Service. “You” and “your” refer to the person using the Service and, where applicable, the Discord server, organisation, or community on whose behalf that person is acting.
1. Acceptance and authority
By inviting Tiko to a Discord server, configuring the Service, using any feature of the Service, or otherwise accessing the Service, you agree to be bound by these Terms and the Privacy Policy, which forms part of these Terms.
If you use or configure Tiko on behalf of a Discord server, organisation, or community, you represent that you are authorised to do so and to accept these Terms on its behalf. If you do not have that authority, you must not invite, configure, or use Tiko for that server, organisation, or community.
2. Eligibility
You may use Tiko only if you are permitted to use Discord under Discord’s age requirements and applicable law. If you have not reached the age of majority in your place of residence, you may use Tiko only with the involvement or permission of a parent or legal guardian where required by law.
You must have the legal capacity to accept these Terms. If you accept these Terms on behalf of another person or entity, you represent that you have authority to bind that person or entity.
3. Discord and other applicable rules
Tiko operates through Discord and depends on Discord’s services and application programming interfaces. Your use of Tiko is subject to Discord’s Terms of Service, Community Guidelines, Developer Terms of Service, Developer Policy, and other Discord rules and policies applicable to bots, applications, and users.
You must not use Tiko in a manner that violates those rules or causes Tiko to violate them. Tiko is an independent third-party service and is not owned, operated, sponsored, or endorsed by Discord.
4. The Service
Tiko is a Discord bot that provides features intended to facilitate ordinary participation and interaction within Discord servers, together with economy, social, and utility features. These features include but are not limited to XP and leveling; virtual currencies and item inventories; marketplaces and player-to-player trading; daily rewards and streaks; quests; role-based payouts for welcoming and reviving activity; mini-games; activity-triggered drops and lootboxes; social and gifting commands; aura and reputation features; rewards for server boosting; leaderboards; utility tools; and server administration and configuration tools.
The Service is provided in the form and at the times determined by us. Features may be introduced, modified, restricted, suspended, or discontinued at any time. Access to a feature may depend on level, role, server configuration, permissions, availability, or other conditions. No particular feature is guaranteed to remain available.
5. Permission to use the Service
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable permission to access and use Tiko in Discord servers that you manage or are authorised to configure, solely for the Service’s intended purposes.
You must not copy, modify, distribute, sell, sublicense, lease, reverse engineer, decompile, disassemble, or create derivative works from Tiko or any part of the Service, except to the extent that applicable law does not permit that restriction. You must not use the Service to develop or operate a competing service, or access it through unauthorised means.
6. Server owner and administrator responsibilities
If you invite or configure Tiko for a server, you are responsible for:
- obtaining and maintaining the permissions required to add and configure bots;
- selecting appropriate permissions, channels, roles, and settings for your server;
- reviewing role hierarchy and permissions before enabling role, reward, or other administrative features;
- ensuring that your configuration complies with Discord’s rules and your server’s own rules; and
- informing members of any server rules or notices that apply to their use of Tiko.
Server owners and administrators remain responsible for the operation and moderation of their servers. Tiko does not replace the judgment, supervision, or moderation of a server owner or administrator.
7. Acceptable use
You must not, and must not permit another person to:
- use Tiko for unlawful, fraudulent, abusive, harassing, deceptive, or harmful activity;
- spam, mass-message, or otherwise misuse Discord or Tiko;
- interfere with, disrupt, overload, or attempt to gain unauthorised access to the Service or its supporting systems;
- exploit, reproduce, distribute, or publicly disclose bugs or vulnerabilities in a manner that may harm Tiko or its users;
- automate activity for the purpose of farming rewards or bypassing limits, cooldowns, or other safeguards;
- manipulate leaderboards, balances, rewards, drops, trades, or other Service outcomes through exploits or unauthorised automation;
- misrepresent an affiliation with Tiko or Discord, or sell or advertise access to Tiko in a misleading manner; or
- use Tiko in a way that violates these Terms, Discord’s rules, or the rights of another person.
We may investigate suspected misuse and may take action, including limiting, suspending, or terminating access, where we reasonably consider it necessary to protect the Service, users, Discord, or a server community.
8. Virtual items and in-Service progress
The Service may include XP, levels, currencies, items, inventories, streaks, rewards, aura, rankings, and other digital features (collectively, “Virtual Items”). Virtual Items are not property and have no cash or real-world value. They are provided only as part of the Service and do not represent money, stored value, an account balance, or an ownership interest.
Virtual Items may not be redeemed for cash, goods, services, or anything of value outside the Service. They may not be bought, sold, transferred, or exchanged for real money or real-world goods. Transfers between users are permitted only through features expressly provided by Tiko.
We may correct, adjust, rebalance, suspend, reset, or remove Virtual Items or related progress, including to address errors, exploits, abuse, unauthorised activity, technical issues, or changes to the Service. We are not required to restore or compensate for Virtual Items or progress that is lost, changed, or made unavailable.
Randomised, probability-based, or time-based features do not guarantee any particular reward, payout, drop, streak, ranking, balance, or other outcome. You must not rely on Virtual Items or Service progress as having any value outside Tiko.
9. Notifications
As part of providing the Service, Tiko may send direct messages or other notifications through Discord. These notifications may include:
- notices to server owners or administrators concerning material feature additions, changes, removals, or configuration matters that may affect their server; and
- notices to users concerning certain rewards, payouts, reminders, quest activity, gifts, streaks, or other events connected with their use of Tiko.
By using Tiko or the relevant feature, you agree that these notifications may be sent through Discord. You may disable or restrict certain notifications through Tiko’s settings, where available, or through Discord’s privacy and messaging controls. Tiko will not circumvent Discord’s privacy, blocking, or opt-out controls. Notifications may not be delivered if they are blocked, filtered, disabled, or otherwise restricted by Discord or your settings.
Notifications are provided for convenience only. We do not guarantee that any notification will be sent, received, timely, complete, or accurate.
10. Privacy and data
Tiko may process Discord-related information that is necessary to provide, secure, maintain, and improve the Service. The categories of information processed, the purposes of processing, retention practices, and available choices are described in the Privacy Policy.
You remain responsible for the content, permissions, and activity of your Discord server. You must not provide Tiko with information that you are not authorised to provide or permit Tiko to access information in breach of another person’s rights or Discord’s rules.
11. Third-party services
The Service depends on Discord and may depend on hosting providers, infrastructure providers, APIs, or other third-party services. Those services are operated by their respective providers and may be subject to separate terms and privacy policies.
We do not control and are not responsible for the availability, security, content, policies, or performance of third-party services. A change, interruption, restriction, or failure affecting a third-party service may affect Tiko without creating an obligation for us to maintain or replace the affected functionality.
12. Availability and disclaimers
To the maximum extent permitted by applicable law, Tiko is provided on an “as is” and “as available” basis, without warranties or conditions of any kind, whether express, implied, statutory, or otherwise. We do not warrant that Tiko will be uninterrupted, secure, timely, accurate, complete, or free from defects, errors, malware, or other harmful components.
The Service may be unavailable or operate unexpectedly because of maintenance, updates, bugs, configuration errors, infrastructure failures, Discord changes or restrictions, third-party services, network problems, abuse, or other circumstances outside our reasonable control. We do not guarantee the preservation of any Virtual Items, progress, data, configuration, streak, level, ranking, or other Service result.
Nothing in these Terms excludes or limits a warranty, right, or remedy that cannot lawfully be excluded or limited in your place of residence.
13. Suspension and termination
You may stop using Tiko and remove it from a server at any time. We may suspend, restrict, or terminate access to all or part of the Service, with or without notice, if we reasonably believe that:
- you or the server have violated these Terms or Discord’s rules;
- the Service has been misused, exploited, or placed at risk;
- action is required by Discord, law, a service provider, or a security concern; or
- the Service or a feature is being discontinued or materially changed.
On suspension, termination, or removal of Tiko from a server, your permission to use the affected Service ends immediately. Virtual Items, progress, configuration, and related data may be deleted or become inaccessible, subject to the Privacy Policy and any data-retention obligations that apply.
Any provision that by its nature should continue after termination will remain in effect, including provisions concerning Virtual Items, intellectual property, disclaimers, liability, indemnification, disputes, and general provisions.
14. Intellectual property
Tiko and the Service, including their software, code, name, logos, designs, interfaces, documentation, graphics, text, and other content provided by us, are owned by us or our licensors and are protected by applicable intellectual property laws.
Except for the limited permission expressly granted in these Terms, no right, title, or interest in Tiko or the Service is transferred to you. You must not remove or alter proprietary notices or use Tiko’s name, branding, or other protected material in a way that suggests an affiliation, sponsorship, or endorsement without our prior written permission.
If you provide feedback, suggestions, or ideas concerning Tiko, you grant us a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable right to use, reproduce, modify, publish, distribute, and otherwise exploit that feedback for any purpose without compensation or attribution.
15. Limitation of liability
To the maximum extent permitted by applicable law, Tiko and its operator, contributors, licensors, service providers, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, Virtual Items, progress, revenue, profits, goodwill, business opportunity, or other intangible loss, arising out of or relating to Tiko, these Terms, or your inability to use the Service, regardless of the cause of action and even if the possibility of such loss was foreseeable or had been communicated to us.
To the maximum extent permitted by applicable law, the total aggregate liability of Tiko and the persons and entities listed above for all claims arising out of or relating to Tiko or these Terms will not exceed the greater of: (a) the amount you paid to us for the Service during the twelve (12) months before the event giving rise to the claim; or (b) USD $100.
The limitations in this section apply only to the extent permitted by applicable law and do not limit liability that cannot legally be limited or excluded.
16. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Tiko and its operator, contributors, licensors, service providers, and affiliates from and against claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising out of or relating to:
- your use or misuse of Tiko;
- your breach of these Terms or Discord’s rules;
- your server’s configuration, content, permissions, or activity; or
- your violation of another person’s rights or applicable law.
We may assume exclusive control of the defence of any matter subject to indemnification, and you agree to cooperate with that defence. You may not settle an indemnified claim in a way that admits liability on our part or imposes an obligation on us without our prior written consent.
17. Disputes
If a dispute arises out of or relates to these Terms or Tiko, you agree to contact us through the official Tiko Discord server and make a reasonable good-faith effort to resolve the matter informally before pursuing a formal claim.
This section does not prevent either party from taking immediate action where necessary to protect its rights, prevent misuse of the Service, or comply with a legal or regulatory requirement.
18. Changes to these Terms
We may amend these Terms to reflect changes to Tiko, the Service, applicable requirements, or our business practices. The current version will be posted at the location where these Terms are made available and will state its effective date.
For material changes, we may provide additional notice through the official Tiko Discord server, the Service, or other reasonable means. Your continued use of Tiko after the effective date of an amendment constitutes acceptance of the revised Terms. If you do not agree to a revised version, you must stop using Tiko and remove it from any server you manage.
19. General provisions
These Terms, together with the Privacy Policy and any additional terms expressly incorporated by reference, constitute the entire agreement between you and us concerning Tiko and supersede prior agreements or understandings concerning the same subject matter.
If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, reorganisation, sale of assets, or transfer of the Service.
Nothing in these Terms creates a partnership, joint venture, employment relationship, agency relationship, or franchise between you and us. Headings are for convenience only and do not affect interpretation.
